TAXATION, TARIFF & CUSTOMS
We handle tax cases before the Court of Tax Appeals and the Supreme Court and appear before the BIR and the BOC as well as handle queries regarding the proper interpretation and implementation of the provisions of the National Internal Revenue Code and the Customs Modernization and Tariff Act (CMTA) as well as special tax incentives.
MARITIME & ADMIRALTY
This highly specialized area of law practice covers the advocacy and representation of clients in litigation of cases involving the appropriate interpretation and application of several interrelated provisions of the Civil Code, Code of Commerce, the Carriage of Goods by the Sea Act (COGSA) governing vessels and its cargoes, the Insurance Code, the Customs Modernization and Tariff Act and the Philippine Ports Authority Law governing the risks, damages, and accidents of maritime commerce and the claims arising therefrom. In addition the Firm renders legal opinions, counseling on documentation and step-by-step processes, procedures and implementation of import and export transactions in domestic and international trade, as well as handling of cargoes and freight forwarding.
LABOR RELATIONS & PERSONNEL MANAGEMENT
Our Firm has an extensive labor practice, which includes the handling of quasi-judicial cases (illegal dismissal, unfair labor practices, strikes and lock-outs, etc.) before the National Labor Relations Commission (NLRC) and administrative cases (labor standards, visitorial and inspection powers of the DOLE Secretary, violations on labor-only contracting, etc.), before the DOLE, as well as appeals therefrom to the Court of Appeals and Supreme Court. We also render advise on labor matters (such as compliance with labor standards, occupational safety and health standards, and legitimate job-contracting, etc.), to minimize, if not avoid labor controversies.
BANKING & FINANCE
Our services cover counseling on the appropriate interpretation of Philippine banking laws and the implementing rules periodically promulgated by the Bangko Sentral ng Pilipinas and the Philippine Insurance Corporation.
INTELLECTUAL PROPERTY LAWS, COPYRIGHT AND TRADEMARK PROTECTION
Intellectual property rights in our country are primarily governed by the Intellectual Property Code of the Philippines (R.A. 8293), and other special laws, like the Optical Media Act of 2003 (R.A. 9239). We are also a signatory, and thus adhere, to the WTO Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS).
Intellectual property rights consist of copyright and related rights; trademarks and service marks; geographical indications; industrial designs; patents; layout designs (topographies) of integrated circuits; and, protection of undisclosed information (trade secrets). The administration and implementation of the country’s policies on intellectual property rights rests with the Intellectual Property Office (IPO), headed by a Director General, with two (2) Deputies Director General.
Our services employ a multi-faceted approach to the protection of the intellectual property rights of our clients, from the giving of advice on legal issues and concerns thereon, to the filing of protests and prosecution of inter-partes proceedings with the IPO, and appeals to the higher courts (Court of Appeals and Supreme Court).
